MINUTES OF THE SPECIAL MEETING OF THE RAMAPO TOWN BOARD HELD ON JULY 19, 2007

 

The Town Board of the Town of Ramapo convened in Special Session  on Thursday, July 19, 2007 in the Office of the Supervisor at Ramapo Town Hall, 237 Route 59, Suffern, New York.

RESOLUTION OF INTENT: PURCHASE OF CROW HOUSE

The following resolution was moved by Councilman Friedman, seconded by Councilwoman Hunter and unanimously adopted by those board members present:

 

Resolution No. 2007 – 438

     WHEREAS, the Town of Ramapo is considering the purchase of the Crow House at 92 South Mountain Road, New City, New York, the historic studio and residence of H. V. Poor, and

     WHEREAS, the Town of Ramapo is eligible to submit an application to the New York State Office of Parks, Recreation and Historic Preservation for matching funds in the amount of $500,000 towards the acquisition of the above property,

     NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ramapo that Christopher P. St. Lawrence, Supervisor of the Town of Ramapo, is hereby authorized and directed to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $500,000, and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to the Town of Ramapo for acquisition of Crow House, the New City studios and residence of H. V. Poor and, if approved, execute a conservation easement/preservation covenant to the deed of the assisted property.

 

 

AUTHORIZATION TO CLEAN UP #2 TIOKEN ROAD

The following resolution was moved by Councilman Stein, seconded by Councilman Friedman and unanimously adopted by those board members present:

 

Resolution No. 2007 - 439

     WHEREAS, the Department of Building, Planning and Zoning has advised the Town Board that the property located at 2 Tioken Road, Spring Valley, New York is overgrown with weeds and plant growth in excess of ten inches, and

     WHEREAS, the Property Maintenance Code of New York State, a part of the New York State Uniform Fire Prevention and Building Code, Section 302.4, provides that all premises shall be maintained free from weeds or plant growth in excess of ten inches, and

     WHEREAS, a Notice of Violation, number 07-125, was posted on the property on June 11, 2007 directing that the excess weeds and plant growth be removed, and

     WHEREAS, an inspection has indicated that the excess weeds and plant growth have not been removed,

     NOW, THEREFORE, BE IT RESOLVED that pursuant to Section 302.4 of the Property Maintenance Code of New York State, the Town of Ramapo Highway Department is hereby authorized to enter upon 2 Tioken Road, Spring Valley, New York to cut and destroy the weeds and plant growth in excess of the New York State requirement, and

     BE IT FURTHER RESOLVED that the cost of removal shall be placed as a lien against 2 Tioken Road, Spring Valley, New York.

 

 

AUTHORIZATION TO REMOVE DANGEROUS TREES AT  BESEN PARK

The following resolution was moved by Councilman Stein, seconded by Councilwoman Hunter and unanimously adopted by those board members present:

 

Resolution No. 2007 – 440

     WHEREAS, the Town has a Park in Monsey called “Besen Park,” and

     WHEREAS, the Parks & Recreation Department has advised the Town Board that there are several trees in danger of falling which creates a hazard to park users, and

     WHEREAS, said trees must be removed immediately to remove the hazardous condition,

     NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ramapo that, pursuant to Section 103 of the General Municipal Law, it hereby declares an emergency permitting the removal of the dangerous trees at Besen Park without the necessity of soliciting bids, and

     BE IT FURTHER RESOLVED that it hereby retains O’Sullivan Tree Care, 611 Route 303, Blauvelt, New York 10913, to remove the hazardous trees at Besen Park at a fee not to exceed $15,000.00, and

     BE IT FURTHER RESOLVED that Ilan Schoenberger, the Director of Finance is hereby authorized to amend the 2007 Town Budget as follows:

 

     Transfer $15,000.00 from 7197H18.39909(Transfer Out) to 7197H14.3499 (Misc.)

     To fund the above tree removal

APPROVAL OF PAYMENT IN LIEU OF TAX AGREEMENT: VILLAGE OF SPRING VALLEYSPRING VALLEY SITE III

The following resolution was moved by Councilman Friedman, seconded by Councilwoman Hunter and unanimously adopted by those board members present:

 

Resolution No. 2007 –441

     WHEREAS, the Village of Spring Valley has requested that the Town of Ramapo enter into a Payment in Lieu of Taxes Agreement (PILOT) with respect to the following project:

 

            Spring Valley Site III Housing Development Fund Corp. (“HDFC”) and Spring Valley Site III, LLC (“Company”) will be constructing and operating a project consisting of 53 residential units for senior citizens of low income and approximately 11,500 square feet of commercial or retail space at property located at 65 No. Main Street, 73-79 No. Main Street, 50 No. Madison Avenue, 81-83 No. Main Street, 54 No. Madison Avenue, 89 No. Main Street, and 36 Madison Avenue, Spring Valley, and

     WHEREAS, pursuant to Section 577 of the Public Housing Finance Law, the Town Board may exempt the real property of a housing project of a housing development fund from local and municipal taxes including school taxes, other than assessments for local improvements, to the extent of all or a part of the value of the completed project, and

     WHEREAS, pursuant to a proposed pilot agreement, upon issuance of temporary or permanent certificates of occupancy, the company shall make annual payments in lieu of taxes in the amount of $82,500 payable as follows:

                                    a)         54% to Village of Spring Valley

                                    b)         4% to the Town of Ramapo

                                    c)         4% to the County of Rockland

                                    d)         38% to the East Ramapo School District,

     NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ramapo that it agrees to enter into a Pilot Agreement with the Village of Spring Valley, Spring Valley Site III Housing Development Fund Corp. and Spring Valley Site III, LLC exempting from taxes the housing project located at 65 No. Main Street, 73-79 No. Main Street, 50 No. Madison Avenue, 81-83 No. Main Street, 54 No. Madison Avenue, 89 No. Main Street, and 36 Madison Avenue, Spring Valley, New York, and

     BE IT FURTHER RESOLVED that the Supervisor is hereby authorized to execute a Pilot agreement in a form approved by the Town Attorney’s office.

The following resolution was moved by Councilman Stein, seconded by Councilman Friedman and unanimously adopted by those board members present:

 

Resolution No. 2007 –442

     WHEREAS, the Village of Spring Valley has requested that the Town of Ramapo enter into a Payment in Lieu of Taxes Agreement (PILOT) with respect to the following project:

            Spring Valley Site IV Housing Development Fund Corp. (“HDFC”) and Spring Valley Site IV LLC (“Company”) will be constructing and operating a project consisting of 72 residential units for low income families and individuals and approximately 11,000 square feet of commercial or retail space at property located at 70 – 94 North Main Street, Spring Valley, New York, and

     WHEREAS, pursuant to Section 577 of the Public Housing Finance Law, the Town Board may exempt the real property of a housing project of a housing development fund from local and municipal taxes including school taxes, other than assessments for local improvements, to the extent of all or a part of the value of the completed project, and

     WHEREAS, pursuant to a proposed pilot agreement, upon issuance of temporary or permanent certificates of occupancy, the company shall make annual payments in lieu of taxes in the amount of $50,000 payable as follows:

                                    a)         54% to Village of Spring Valley

                                    b)         4% to the Town of Ramapo

                                    c)         4% to the County of Rockland

                                    d)         38% to the East Ramapo School District,

     NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ramapo that it agrees to enter into a Pilot Agreement with the Village of Spring Valley, Spring Valley Site IV Housing Development Fund Corp. and Spring Valley Site IV LLC exempting from taxes the housing project located at 70-94 North Main Street, Spring Valley, New York, and

   BE IT FURTHER RESOLVED that the Supervisor is hereby authorized to execute a Pilot agreement in a form approved by the Town Attorney’s office.

     RESOLVED by the Town Board of the Town of Ramapo that the Special Meeting of the Ramapo Town Board held this evening, July 19, 2007, be hereby adjourned at 5:55 pm.
